These Terms of Service ("Terms") are a binding agreement between you and BetterChess governing your access to and use of the BetterChess website and application (the "Service"). By creating an account, ticking the acceptance box at sign-up or checkout, subscribing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 13 years old to use the Service, and at least 18 years old (or the age of majority where you live) to purchase a subscription. If you are 13–17, you may use the Service only with the knowledge and consent of a parent or legal guardian who agrees to these Terms and is responsible for your use and any purchases. The Service is not intended for and may not be used by children under 13. We may ask you to confirm your age and may suspend accounts we believe do not meet these requirements.
The Service provides chess practice, puzzles, games against computer opponents, and AI-assisted coaching that combines chess-engine analysis with automated, AI-generated commentary and optional synthesized voice. Coaching output is generated automatically and may be incomplete or inaccurate. It is provided for educational and entertainment purposes only and is not professional advice. You are responsible for your own decisions.
You sign in using your email and a one-time code. You are responsible for your account and all activity under it, for keeping your contact details accurate, and for maintaining the security of your email. Notify us promptly of any unauthorized use.
BetterChess Pro is a recurring subscription that renews automatically. Before you pay, the price and billing frequency are shown and you must affirmatively agree. By subscribing you authorize us and our payment processor to charge your payment method US $99 per month (plus any applicable taxes) on a recurring basis until you cancel. Payments are processed by our merchant of record, Lemon Squeezy, whose buyer terms also apply; Lemon Squeezy handles billing, taxes, and payment data, and sends you a receipt and a link to manage or cancel your subscription. Prices may change for future billing periods with prior notice.
You may cancel at any time via the link in your Lemon Squeezy receipt or by emailing info@betterchess.co. Cancellation stops future charges and takes effect at the end of the current billing period; you keep access until then. All payments are final and subscription fees are non-refundable — including for partial periods or unused time — except where a refund is strictly required by applicable law. If we suspend or terminate your account for cause, we may stop future billing; fees already paid for the current period are not refunded. Refund handling is also subject to Lemon Squeezy's buyer terms.
You retain ownership of the content you submit — including your games, moves, puzzle attempts, profile answers, and the questions you ask the coach ("Your Content"). You grant BetterChess a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, analyze, and transmit Your Content as needed to operate, secure, maintain, improve, and personalize the Service (including sending relevant data to the AI and voice providers described in our Privacy Policy). You represent that you have the rights to submit Your Content and that it does not violate any law or third-party right.
You agree not to: (a) reverse engineer, scrape, or extract source code or data except as permitted by law; (b) abuse, overload, or disrupt the Service or its infrastructure, including the AI and voice endpoints; (c) resell, sublicense, or share access; (d) use the Service to violate any law or third-party right; (e) bypass payment, authentication, or usage limits; or (f) upload unlawful, harmful, or infringing content. We may impose rate limits and other safeguards.
You must not use the Service, its coaching, analysis, or move suggestions to: receive assistance during a live or rated game, online or over-the-board tournament, or any competition where outside help is not allowed; cheat or evade the fair-play, anti-cheating, or terms of any chess platform; impersonate another player; or submit another person's username, account, or data without their authorization. The Service is for your own training and practice only.
The Service, including its software, design, text, and branding, is owned by us or our licensors and protected by law. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms. Chess puzzle data is derived from the Lichess open puzzle database (CC0). All rights not expressly granted are reserved.
The Service relies on third parties, including Anthropic (AI coaching), ElevenLabs (voice), Lemon Squeezy (payments / merchant of record), Supabase (database), Vercel (hosting), and Resend (email). Your use may be subject to their terms, and we are not responsible for their acts or omissions. See our Privacy Policy for what data each receives.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT COACHING, ANALYSIS, OR RATINGS WILL BE ACCURATE OR ACHIEVE ANY OUTCOME.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR THE FAILURE TO ACHIEVE ANY RATING OR RESULT. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
You agree to indemnify and hold harmless BetterChess and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, Your Content, or your violation of these Terms or any law or third-party right.
You may stop using the Service at any time (see cancellation above). We may suspend or terminate your access at any time, with or without cause or notice, including for violations of these Terms. Sections 6, 9, 11, 12, 13, and 15 survive termination.
These Terms are governed by the laws of the State of Israel, without regard to conflict-of-laws rules, and the competent courts of Tel Aviv, Israel will have exclusive jurisdiction. To the extent permitted by law, you and we agree to resolve disputes individually and waive any right to participate in a class action. These provisions do not override mandatory, non-waivable consumer-protection or data-protection rights you have under the laws of your country of residence.
We may update these Terms. Material changes will be reflected by updating the "Last updated" date and, where appropriate, by notice. Your continued use after changes take effect constitutes acceptance.
